How We Obtain Your Personal Information

You can choose to provide your personal information to us when using the online forms provided on our website, setting up an account with us, by forums.  Our site offer publicly accessible forums. You should be aware that any information you provide in these areas is public and may be read, collected, and used by others who access them and may remain on the public forum indefinitely. Legal Basis for Use of Your Personal Information

We consider that our legal bases for using your personal information as set out in this Privacy Policy are as follows:
• our use of your personal information is necessary to perform our obligations under any contract with you (for example, to provide you with our Services); or
• our use of your personal information is necessary for complying with our legal obligations (for example, our obligations to keep records for taxation purposes); or
• where neither of the above points applies, use of your personal information is necessary for our legitimate interests or the legitimate interests of others (for example, to ensure the security of our website).

Our legitimate interests are to:

(ii) conduct internal corporate reporting, business administration, ensure adequate insurance coverage for our business, ensure the security of company facilities, carry out research and development, and identify and implement business efficiencies;

Disclosure to Third Parties

We disclose your personal information to the following categories of third parties, for the purposes described below and in section 5 (How We Use Your Personal Information) above:
• Third parties who assist us with our sales and marketing activities (such as Hubspot); for example, for sending out e-mails;
• Social media platforms (such as Facebook) to target our adverts at people we think may be interested in our Services;
• Cloud service providers (such as Salesforce);
• AWS Web Services and IBM Cloud, which hosts our Mezmo solution and may access personal information stored within that solution when providing support and maintenance services.
• With other vendors, we engage to provide you with aspects of the Services, such as [ payment processors, utility providers, suppliers of technical and support services, insurers, logistic providers, cloud service providers and other providers] with a view to facilitating communications with you and other users, maintaining our databases, and processing payments. • If Mezmo is involved in a merger, acquisition, reorganization, dissolution, sale of all or a portion of its assets or similar event, we may disclose your personal information to the prospective seller or buyer of our business or assets and, where we sell substantially all of our assets, your personal information held by us will be one of the transferred assets, provided that, in such an event, you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information, to subsidiaries and affiliates for purposes consistent with this Privacy Policy.
With your consent:
• We may share your information with co-sponsors who organize events with us in order to allow them to provide you with offers, promotions, ads or products and services. Before we share personal information, we enter into written agreements with recipients which contain data protection terms that safeguard your data. If you agree to sharing of your personal data for the co-sponsor's direct marketing purposes, you may opt-in at the time of signing up for the event. Your Rights in Relation to Your Personal Information

You have certain rights in relation to your personal information. You can access, correct, amend, or delete certain personal information by accessing the settings of your account. Your rights will vary depending on where you are located but they could include:

Right of access: a right of access to any personal information we hold about you. You can ask us for a copy of your personal information; confirmation as to whether your personal information is being used by us; details about how and why it is being used; and details of the safeguards which are in place when we transfer your information outside of the EU, UK, Switzerland or the European Economic Area ("EEA")

• Right to update your information:  a right to request an update to any of your personal information which is out of date or incorrect.

• Right to delete your information:  a right to ask us to delete any personal information which we are holding about you in certain specific circumstances. We will pass your request onto other recipients of your personal information unless that is impossible or involves disproportionate effort. • Right to stop marketing: a right to ask us to stop using your personal information for direct marketing purposes, such as receiving our newsletter or marketing emails. If you exercise this right, we will stop using your personal information for this purpose but will retain your personal information for other purposes.

• Account closure: You can make a request to opt-out of all collection by terminating your account with us and ceasing all use of the Services. To delete your account, please email us at privacy@mezmo.com.

We will consider all such requests and provide our response within a reasonable period (and in any event within one month of your request unless we tell you we are entitled to a longer period under applicable law). Please note, however, that certain personal information may be exempt from requests in certain circumstances and we may need to retain personal information as required pursuant to applicable law, for example, if we need to keep using the information to comply with our own legal obligations, to establish, exercise or defend legal claims, to comply with records retention obligations, to resolve disputes or enforce our contractual agreements, or otherwise as required by law.

If an exception applies, we will tell you this when responding to your request. If necessary, we may need to ask you to provide information to enable us to confirm your identity before responding to any request you make.

International Transfers

Your personal information will be used, stored, and/or accessed by staff operating outside the EU, UK Switzerland or the EA working for us, service providers, or suppliers. For example, Mezmo is located in the United States, and we process and store information on servers located in the United States. By using the Services, you acknowledge that your personal information may be transferred to locations that may be outside of your country of residence, including to the United States. If we provide any personal information about you to any non-EU, non-UK, non-Swiss and/or non-EEA service providers or suppliers, where we are required to do so, we will take appropriate measures to ensure that the recipient protects your personal information adequately in accordance with this Privacy Policy and applicable law. These measures include the following:• Ensuring that there is an adequacy decision in respect of the country to which the personal information is being transferred. which means that either the EU, UK, Switzerland Government, in the case of transfers out of the UK, Switzerland or the European Commission in the case of transfers out of the EEA. has concluded that the laws and practices of the destination country provide adequate protection for personal information.
• Where we have in place standard model contractual arrangements with the recipient of personal information which have been approved by the European Commission (or the UK Government for transfers out of the UK). These standard model contractual clauses include certain safeguards to protect personal information.
• The EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as described further in our Data Privacy Framework Policy. While Mezmo has self-certified to and continues to comply with, the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) frameworks set forth by the U.S Department of Commerce, we do not rely on these frameworks for the purpose of international data transfer compliance.

MEZMO COMMITMENTS

Mezmo Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.  Mezmo Inc. has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF.  Mezmo Inc.  has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.  To learn more about the Data Privacy Framework (DPF) program, and to view our certification, please visit https://www.dataprivacyframework.gov/.
